Terms of Service — Armchair Commentator

1. Agreement to terms

By accessing or using Armchair Commentator (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service.

The Service is operated by Glitchless, s.p., a sole proprietorship registered in Slovenia, EU ("we", "us", "our").

2. Eligibility

You must be at least 16 years old to use the Service. By creating an account, you represent that you meet this age requirement.

3. Accounts

You may create an account using email & password or by signing in through a supported OAuth provider (Apple, Google, GitHub). You are responsible for:

Keeping your login credentials confidential.
All activity that occurs under your account.
Notifying us promptly if you suspect unauthorised access.

We reserve the right to suspend or terminate accounts that violate these Terms.

4. The Service

Armchair Commentator is a prediction game platform. Users submit predictions for sporting events, earn points based on accuracy, and compete on leaderboards within private groups.

Not gambling. The Service does not involve real-money wagering, betting, or any financial stakes. No prizes of monetary value are awarded. The Service is for entertainment purposes only.

5. Acceptable use

You agree not to:

Use the Service for any unlawful purpose.
Attempt to gain unauthorised access to any part of the Service.
Interfere with or disrupt the Service or its infrastructure.
Use bots, scripts, or automated tools to interact with the Service unless explicitly permitted.
Impersonate another person or misrepresent your identity.
Harass, abuse, or engage in harmful behaviour towards other users.

6. User content

"User content" includes display names, predictions, and group names you create. You retain ownership of your content but grant us a non-exclusive, worldwide, royalty-free licence to use, display, and store it as necessary to operate the Service.

We may remove user content that violates these Terms at our discretion.

7. Intellectual property

All rights, title, and interest in the Service (excluding user content), including but not limited to design, code, logos, and branding, belong to Glitchless, s.p. You may not copy, modify, or distribute any part of the Service without our written consent.

8. Privacy

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal data in accordance with the EU General Data Protection Regulation (GDPR).

9. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied. We do not guarantee that the Service will be uninterrupted, error-free, or secure.

Prediction scores and leaderboards are calculated automatically and may contain errors. We do not warrant the accuracy of scores or rankings.

10. Limitation of liability

To the maximum extent permitted by applicable law, Glitchless, s.p. shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the Service.

Because the Service is free of charge and does not involve financial transactions, our total aggregate liability to you for any claims is limited to €100.

11. Termination

You may stop using the Service at any time. You can request deletion of your account by emailing [email protected].

We may suspend or terminate your access at any time for violation of these Terms or for any other reason, with or without notice.

12. Governing law & jurisdiction

These Terms are governed by the laws of the Republic of Slovenia. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts in Slovenia.

If you are an EU consumer, nothing in these Terms affects your mandatory consumer protection rights under the laws of your country of residence.

13. Changes to these terms

We may update these Terms from time to time. If we make material changes, we will notify registered users by email. Continued use of the Service after changes take effect constitutes your acceptance of the updated Terms.
